Terms of Use.

Listed below are the general terms and conditions regarding our service.
For the benefit of these terms and conditions Sugar Waves.
“Customer” means the person or group who confirms the reservation and undertakes a trip.
Our dedication is always to the client and to representing their best interests.
We always look for the highest quality of partners as we try to offer something for everyone. We check standards and monitor feedback at all times. When we consider that the quality or safety standards are not of the highest level, we will in all cases take steps to improve or remove the product from our offer.

EXEMPTION OF DAMAGES AND LIABILITIES
In the event that one of our boats is damaged as a result of the actions of the client or their guest, Sugar Waves will inform the client within 24 hours. The damage and the cause of the damage will be indicated in writing within 48 hours.
Sugar Waves will obtain a quote from a relevant contractor for any required repairs or replacement. The quote will be sent to the customer for payment or charged to the payment card.
Clients may be requested and required to pay up to €5000 for any damage caused to our vessels until the full assessment of repairs has been calculated. Any excess quantity is returned to the customer once the cost of repair has been settled.
Any dispute must be reported in writing to the Director of Operations.
Any additional cleaning required as a result of your charter is considered chargeable under the damage waiver agreement.
Any fines incurred through the local maritime authority as a direct action or breach of Sugar Waves policies or local laws will be entirely attributable to the customer under waiver of damages.
No responsibility is accepted for any additional loss or expense incurred by accident, injury, illness or death.
All persons under the age of 18 must be supervised by a mature adult.
Any customer-supplied food and beverages are subject to Sugar Waves approval and must be reported 24 hours prior to travel. This is to protect the vessel from certain damage that can occur through spills etc.
Sugar Waves does not allow smoking in the entire interior of the yacht.

BOOKING
Sugar Waves requires a deposit prior to the start of the trip. No reservation is confirmed until the deposit has been paid.
Payment balance will be due on or before cruise departure.
Sugar Waves reserves the right to require payment in full at the time of booking.
Itineraries discussed via email and verbally prior to the travel date are always subject to change and update as we take into account tides, winds, weather and other issues beyond our control. SW does not accept any responsibility for changes to the itinerary discussed. Itinerary changes do not constitute cancellation and under these terms, if the client cancels the reservation due to itinerary changes, the liabilities will be shown as a client cancellation.
Typical itinerary changes could be:
• A change in departure and arrival times;
• Inability to use inflatable RIB;
• Inability to stop to swim;
• Inability to do the cave tours with the main boat;
• Inability to use the SUP;
• Change of lunch venue or catering options.
All boat trips are totally governed by the weather and sea conditions. We reserve the right not to operate the tours in case of high waves, the final decision belongs to the skipper of the boat. Safety is always our number 1, 2 and 3 priority.

CANCELLATION BY SUGAR WAVES
SW reserves the right to cancel any reservation made. In case of cancellation, SW will not have any responsibility. In the event SW cancels the reservation, all deposits or payments in full will be returned to the client.
SW is rarely cancelled, but in certain cases it is unavoidable. Cancellations will generally only occur due to bad weather, sea conditions, mechanical failure, or illness leading to a lack of qualified crew.

CANCELLATION BY THE CLIENT
Once a deposit is made, the voyage is secured and as such SW can no longer accept bookings for that time and yacht. Due to this, SW cannot refund a deposit in case of cancellation by the client.
If the customer has made full payment and cancels, then no refund will be possible.
In the event that the client wishes to change the date or time of the charter, SW will try to oblige but, in the event that this is not possible, no refunds will be issued and the original reservation will stand.

BOAT ACCESS
Access to the boats is often by a steep ramp and a step through the water to board the yacht. Many boats also have a fairly narrow access point and then steps. Access can be challenging for the less able and SW cannot accept responsibility for delays or cancellations due to access issues.
However, SW is fully committed to making trips available for all ages and abilities. SW requests sufficient advance notice and communication regarding particular mobility issues to avoid delays, cancellations, and disappointment. The boats are not ideal for the less physically able, but with time and information we can provide additional crew and resources to help make this happen. ALLERGIES
SW does not accept any responsibility for the effects of allergic reactions while in our offices, ships or workspaces. The client is responsible for informing SW of any medical conditions and allergies that may affect the trip. With advance notice, SW can prepare the boats with allergies in mind OR can refuse to accept the reservation if it is considered that there is a risk to health and life.
RELIGIOUS CONSIDERATIONS
It is the customer’s responsibility to inform us of any religious preferences related to food or drink and any other considerations deemed culturally relevant.
SW will endeavor to adapt the trip to the client’s requests taking into account the safety and comfort of our crew and under Portuguese law.

GENERAL
SW only works with yachts that are fully compliant with current and local safety regulations. All yachts are inspected annually and are licensed as charter boats.
SW only employs fully qualified and experienced crew members and captains. Captains’ orders are final and under maritime authority they have the right to terminate any voyage at any time in cases where clients are disrespectful or in cases of antisocial or reckless behavior.

If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions of these Terms will survive. These Terms constitute the entire agreement between us with respect to our Service, and supersede and supersede any prior agreements we may have between us with respect to the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is necessary, we will try to provide at least 15 days notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
PRIVACY POLICY (PP)
All credit/debit card details and personally identifiable information will NOT be stored, sold, shared, rented or leased to third parties.
SW will not transmit any debit / credit card data to third parties.
SW takes appropriate measures to ensure data privacy and security, including through various hardware and software methodologies. However, SW cannot guarantee the security of any information disclosed online.
